PRIVACY POLICY

Your privacy is important to Ocean Glass Public Company Limited (“Ocean”) so we have developed a Privacy Policy that applies to the processing of personal information and sensitive personal information (collectively, “Personal Data”) by Ocean. For this purpose, the term “processing” shall include, but not limited to, the collection, recording, organization, storage, updating or modification, retrieval, consultation, use, consolidation, blocking, erasure or destruction of your personal data.

COLLECTION AND USE OF PERSONAL DATA

You may be asked to provide your personal data anytime you are in contact with Ocean and its subsidiaries company. Ocean and its subsidiaries may share this personal data with each other and use it consistent with this Privacy Policy. They may also combine it with other information to provide and improve our products, services, content, and advertising. You are not required to provide the personal data that we have requested, but, if you choose not to do so, in many cases we will not be able to provide you with our products or services or respond to any queries you may have.

What personal data do we collect

(i) Personal information is defined by the laws of Thailand as any information relating to a person which is identifiable, directly or indirectly, excluding the information of a dead person.

When you register to purchase, apply for commercial credit, purchase a product, contact us including by social media or participate in an market surveys or contests conducted by Ocean or on its behalf, we may collect a variety of your personal information including but not limited to the following:

  • title name and address
  • phone numbers
  • email address
  • contact preferences
  • device identifiers, IP address, location information
  • credit card, debit card, and other bank or financial information
  • profile information where the contact is via social media
  • username, password and other identifiers when you register at Ocean’s website
  • records of communications with Ocean
  • responses to market surveys and contests conducted by Ocean or on its behalf

(ii) Sensitive personal information laws of Thailand refers to any personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, criminal record, trade union membership, genetic data, biometric data, data concerning health or data concerning a natural person’s sex life or sexual orientation, and prohibits the collection of sensitive personal data without express consent from the data subject, except in certain prescribed circumstances (e.g., medical emergency or as required by law).

How do we use your personal data

We may process your personal data for the purposes described in this Privacy Policy, with your consent, for compliance with a legal obligation to which Ocean is subject, for the performance of a contract to which you are party, in order to protect your vital interests, or when we have assessed it is necessary for the purposes of the legitimate interests pursued by Ocean or a third party to whom it may be necessary to disclose information. The personal data we collect allows us to keep you posted on Ocean’s latest product updates and upcoming events. If you don’t want to be on our mailing list, you can opt-out anytime by updating your preferences.

We also use personal data to help us create, develop, operate, deliver, and improve our products, services, content and advertising, audit, and for loss prevention and anti-fraud purposes. We limit our uses of data for anti-fraud purposes to those which are strictly necessary and within our assessed legitimate interests to protect our customers and our services. For certain online transactions we may also validate the information provided by you with publicly accessible sources

We may use your personal data, such as address, location for logistics purpose, and also including date of birth, to verify identity, assist with identification of users, and to determine appropriate services. From time to time, we may use your personal data to send important notices, such as communications about purchases and changes to our terms, conditions, and policies. You may not opt out of receiving these communications.

If you enter into a sweepstake, contest, or similar promotion we may use the information you provide to administer those programs.

If you apply for a position at Ocean or we receive your information in connection with a potential role at Ocean, we may use your information to evaluate your candidacy and to contact you. If you are a candidate, you will receive more information about how Ocean handles candidates’ personal data at the time of application.

We will only process sensitive personal information upon the express consent of the data subject and only for purposes it was provided, or in accordance with law. In processing sensitive personal information, we will inform data subjects of the sensitive personal information that is necessary to fulfill the core functionality of the product or service, and the consequences of refusal to the processing, for the purpose of allowing the data subjects to decide whether or not to give consent.

Source of your personal data where they are not collected from you

We may have received your personal data from other persons if that person has shared their content with you using Ocean products.

If you are a potential candidate for employment with Ocean, we may have received your personal data from third parties such as recruiters or external websites. We will use the personal data we receive to contact you about a potential opportunity or in evaluating your candidacy. If you did not provide us your personal data directly, we will inform you of the source when we first contact you regarding your candidacy. For research and development purposes, we may use datasets such as those that contain images, voices or other data that could be associated with an identifiable person. When acquiring such datasets, we do so in accordance with applicable law in the jurisdiction in which the dataset is hosted. When using such datasets for research and development, we do not attempt to re-identify individuals who may appear therein.

Collection and Use of Non-Personal Data

We also collect data in a form that does not, on its own, permit direct association with any specific individual. We may collect, use, transfer, and disclose non-personal data for any purpose. The following are some examples of non-personal data that we collect and how we may use it:

We may collect information such as occupation, language, postal code, referrer URL, location, so that we can better understand customer behavior and improve our products and services.

We may collect information regarding customer activities on our website, and from our other products and services. This information is aggregated and used to help us provide more useful information to our customers and to understand which parts of our website, products, and services are of most interest. Aggregated data is considered non‑personal data for the purposes of this Privacy Policy.

We may collect and store details of how you use our services, including search queries. This information may be used to improve the relevancy of results provided by our services. Except in limited instances to ensure quality of our services over the Internet, such information will not be associated with your IP address.

If we do combine non-personal data with personal data, the combined information will be treated as personal data for as long as it remains combined.

Cookies and Other Technologies

A cookie is a small file which asks permission to be placed on your computer's storage. Once you agree, the file is added, and the cookie helps analyze web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. The web application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences.

We use traffic log cookies to identify which pages are being used. This helps us analyse data about web page traffic and improve our website in order to tailor it to customer needs. We only use this information for statistical analysis purposes and then the data is removed from the system.

Overall, cookies help us provide you with a better website, by enabling us to monitor which pages you find useful and which you do not. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us. You can choose to accept or decline cookies. Service Providers/Cross-border disclosure

Ocean shares personal data with companies who provide services such as information processing, extending credit, fulfilling customer orders, delivering products to you, managing and enhancing customer data, providing customer service, assessing your interest in our products and services, and conducting customer research or satisfaction surveys. These companies are obligated to protect your information and may be located wherever Ocean operates.

Any personal data provided to Ocean may be transferred to, stored by or disclosed to an overseas recipient. Your personal data may also be processed by employees or by other third parties operating outside of Thailand. Ocean will take reasonable steps, in the circumstances, before your personal data is disclosed to an overseas recipient, to ensure that the overseas recipient does not breach privacy laws in relation to your personal data.

Others

It may be necessary or required by law, legal process, litigation, and/or requests from public and governmental authorities within or outside your country of residence − for Ocean to disclose your personal data. We may also disclose information about you if we determine that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate. We may also disclose information about you, but only where there is a lawful basis for doing so, if we determine that disclosure is reasonably necessary to enforce our terms and conditions or protect our operations or users. This could include providing information to public or governmental authorities. Additionally, in the event of a reorganization, merger, or sale we may transfer any and all personal data we collect to the relevant third party.

When a privacy question or question about personal data received in response to an access/download request is received Ocean may contact you to address your issue. Where your issue may be more substantive in nature, we may request more information from you. All such substantive contacts receive a response wherever possible - providing a response on the issue raised, requesting additional information where necessary or indicating that a response will require additional time. You may at any time refer your complaint to the relevant regulator in your jurisdiction if you are unsatisfied with a reply received from us. If you ask us, we will endeavor to provide you with information about relevant complaint avenues which may be applicable to your circumstances.

Where your complaint indicates an improvement could be made in our handling of privacy issues we will take steps to make such an update at the next reasonable opportunity. In the event that a privacy issue has resulted in a negative impact on you or another person we will take steps to address that with you or that other person.

Consent and limitation in the processing of personal data

You may choose whether or not to provide your personal data, and, if already provided, you may choose to exercise your right to object, block, or remove such personal data as provided by law. If you would like to exercise your right to object, block, or remove your consent, please contact Ocean using the contact details above. In this case, however, we may not be able to adequately provide you the assistance or services you requested.

When you object, block or remove your consent, Ocean shall no longer process your personal data, except in cases allowed or required by law.
